Pay Fixation for Existing Employees

For an employee who was in service on 30 June 2022, basic pay was to be fixed in BPS-2022 on a point-to-point basis. The employee’s stage in the revised scale was to correspond to the stage occupied in BPS-2017 above the minimum of that scale.

Where an employee was drawing Personal Pay as part of basic pay beyond the maximum of the pay scale on 30 June 2022, the memorandum provided that the employee would continue to draw that pay in BPS-2022 at the revised rates.

Pay Fixation on Promotion

For a promotion from a lower to a higher post or scale before introduction of the revised scales, the employee’s pay in the revised scale could be fixed and enhanced so that it would not be less than the pay that would have been admissible if the promotion had taken place after introduction of BPS-2022.

Annual Increment

The memorandum continued the annual increment, subject to the existing conditions, on 1 December each year.

Previous Ad-hoc Relief Allowances Ceased from 1 July 2022

With the introduction of BPS-2022, the Ad-hoc Relief Allowances granted with effect from 1 July 2016, 1 July 2017, 1 July 2018, 1 July 2019 and 1 July 2021 ceased to exist with effect from 1 July 2022. The memorandum lists the earlier allowances and their admissible rates as follows:

Ad-hoc Relief Allowance-2022 at 15%

The memorandum allowed Ad-hoc Relief Allowance-2022 at 15% of running basic pay of BPS-2017 to civil employees of the Federal Government and civilians paid from Defence estimates. It also covered contingent-paid staff and contract employees employed against civil posts in Basic Pay Scales on standard terms and conditions of contract appointment. The allowance took effect from 1 July 2022 and was to remain frozen at the same level until further orders.

For new entrants, the memorandum provided Ad-hoc Relief Allowance-2022 at 15% of the minimum of the relevant basic pay of BPS-2017 on a notional basis, with effect from 1 July 2022, to remain frozen at the same level until further orders.

Conditions of Ad-hoc Relief Allowance-2022

  • The allowance was subject to income tax.
  • It was admissible during leave and the entire period of leave preparatory to retirement (LPR), except extraordinary leave.
  • It was not to be treated as part of emoluments for calculating pension or gratuity, or for recovery of House Rent.
  • It was not admissible during an employee’s posting or deputation abroad.
  • On repatriation from posting or deputation abroad, it was admissible at the rate and amount that would have applied had the employee not been posted abroad.
  • It was admissible during the period of suspension.
  • For this purpose, the term “Basic Pay” also included Personal Pay granted because annual increments had taken an employee beyond the maximum of the existing pay scale.

Special Pay and Other Allowances Frozen at the 30 June 2022 Level

The memorandum stated that Special Pays, Special Allowances and allowances admissible as a percentage of pay were to remain frozen at the level of admissibility on 30 June 2022. The stated coverage included House Rent Allowance and an Allowance or Special Allowance equal to one month’s basic pay granted to Federal Government employees, irrespective of their posting in a Ministry, Division, Department or Office. The memorandum also included civil employees in BPS-1 to BPS-22 of the Judiciary.

The freeze excluded allowances that were capped by fixing a maximum limit.

Option Between BPS-2017 and BPS-2022

The Ministry, Division, Department or Office concerned was required to obtain a written option from existing employees within 30 days from the date of issue of the memorandum. Employees could choose to continue drawing salary under BPS-2017 or move to BPS-2022. The option, once exercised, was final.

An existing employee who did not exercise and communicate an option within the specified time was deemed to have opted for BPS-2022.

Other Instructions and Anomaly Committee

The memorandum provided that existing rules and orders on the subject would be treated as modified to the extent indicated in the memorandum. Existing rules and orders not modified by it would continue in force. It also provided for an Anomaly Committee in the Finance Division (Regulations Wing) to resolve anomalies, if any, arising from implementation of BPS-2022.
